Jeffery L. Nuckolls joined the law firm in 1991.
As a partner with the firm, Jeff presently serves as outside counsel for
- The Chesapeake Redevelopment and Housing Authority,
- The Virginia State Attorney General/Department of Risk Management,
- The Chesapeake Firefighter's Union,
- The Chesapeake Mosquito Control Commission,
- Bank @LANTEC, and
numerous church, corporate and municipal clients providing representation and consultation in the areas of business, contracts, finance, labor, employment, risk assessment and risk mitigation. Jeff also manages the firm's real estate division with colleagues Cassell Basnight and Kedron Springer, and is one of the firm's senior litigation attorneys.
Jeff Nuckolls was admitted to the Virginia State Bar in 1989.
He is a member of the following Federal Bars:
- The United States District Court for the Eastern District of Virginia, (1989);
- The Fourth Circuit Court of Appeals, (1989); and
- The United States Supreme Court, (1996).
Jeff is a Registered Real Estate Settlement Agent and a former Affiliate with the Hampton Roads Realtors Association. He is a member of the Chesapeake Bar Association and the Association of Trial Lawyers of America. Jeff currently serves as a Director on the Board of Bank @LANTEC. As a Veteran of the United States Air Force, Jeff is also a member of the American Legion and the 10th Security Police Association.
Education
Jeff Nuckolls received his undergraduate education at Christopher Newport College, Newport News, Virginia, and graduated with departmental honors in Political Science in 1986. Jeff received his Juris Doctor in 1989 from George Mason University Law School in Arlington, Virginia.
During law school, Jeff engaged in various activities. Jeff and his teammate took second place in the law school's first year Moot Court Appellate Competition. He received an M.J. Murdock Fellowship with the Washington Legal Foundation, Washington, D.C., where he interned in the Foundation's Legal Studies Division. During his Fellowship, Jeff published an article addressing the Supreme Court's landmark decision in Gideon v. Wainwright, established a pleadings clearing house for First Amendment cases, and he worked with several other colleagues in publishing a study of pro bono cases taken by Washington's top law firms.
During his second year at the law school, Jeff had the honor of being inducted into the Justice Lewis Powell Inn of Phi Delta Phi legal fraternity, the law school's honor fraternity. Jeff was a member of the International Law Society during his tenure at the law school and served as an officer in the Society during his third year. In addition, he served on the law school's year book staff as a photographer during his second and third year.
Current Practice
- Contracts- Drafts and negotiates employment contracts for executives, physicians and other healthcare professionals. Negotiates severance agreements for executives and managers. Analyzes real estate acquisitions including eminent domain and federal tax credits. Drafts and reviews residential and commercial real estate contracts, property management agreements, procurement contracts and service agreements. Conducts real estate settlements.
- Labor and Employment
- Conducts EEO investigations. Investigates, evaluates and litigates Federal Discrimination Actions, State Law Employment Actions, Disability Insurance Issues, Unemployment Claims, and Workers' Compensation Claims. Represents parties in grievances. Employs mechanisms in Alternative Dispute Resolution. Reviews policies and procedures for state and federal legal compliance.
- Risk Assessment and Mitigation
- Analyzes medical protocols, clinical pathways and exposure in the provision of health care treatment. Analyzes and assesses contract issues, tort issues, labor and employment issues, premises liability issues and management issues in determination of liability exposure. Determines insurance needs and applicability for individuals and businesses in consideration of exposure mitigation. Negotiates insurance claims.
- Civil Litigation
- Manages personal injury and civil claims and litigation from initial interview to settlement or jury verdict. Represents the Attorney General's Office/Division of Risk Management in cases alleging misconduct, harassment, contracts, and professional liability. Managed cases netting over $1 million arising under maritime law and products liability.
- Church Law and Taxation
- Represents Churches and Religious Organizations in Federal, State and Municipal organizational issues, Incorporations, IRS Code Section 501 (c) compliance, maintaining tax exempt status, land acquisition and use, finance and budgeting, bond programs, review and drafting of By-laws and Constitutions, litigation and ecclesiastical and charitable immunity, and risk assessment and risk management.
Experience
Associate: Prior to joining the law firm of Basnight, Kinser, Telfeyan, Leftwich and Nuckolls, P.C., Jeff was an associate attorney in another firm providing consultation and support in complex personal injury litigation.
Jeff is experienced in the following aspects of legal services:
- Litigation Research- Investigated aircraft crashes, automotive products liability issues and medical negligence issues for litigation. Conducted legal research in the areas of medical negligence, aircraft design, automotive fuel tank design and highway safety standards. Conducted technical research in the areas of flight, aerodynamics, aircraft and automotive fuel tank design, roadway design and transportation safety.
- Litigation Support
- Drafted discovery, legal and technical memoranda, pleadings, briefs and communications to superiors, clients and witnesses. Presented oral arguments before state and federal judges. Prepared winning briefs and presented oral argument in federal court in a high profile aircraft case.
Law Clerk: During his second year of law school, Jeff law clerked in a firm in Alexandria, Virginia, providing intellectual law property law services. There he served as a law clerk providing research and support in patent, trademark and copyright litigation. He researched patents, trademarks and copyrights, and investigated violations of various trademarks and copyrights for The Grand Ole Opry, WSM Radio, and The Nashville Network.
Military Service: Jeff is a Veteran of the United States Air Force. He served in the Security Police career field undertaking all facets of armed law enforcement duties, including the providing of base security, assessing risk mitigation in resource protection, engaging in crime prevention, investigating crimes against persons and property, and providing combat support. Jeff received special training in automobile accidents investigation and reconstruction and became proficient in that field. He graduated from the Vandalia, Ohio Police Academy and received training at the Ohio State Highway Patrol Academy in Traffic Supervision and Speed Enforcement Radar.
As a junior enlisted member, Jeff was assigned duties as a Desk Sergeant, responsible for management and control of mobile patrol and perimeter entry personnel. He was selected as the First term Airman of the Year for the 10th Security Police Squadron, RAF Alconbury, U.K., and was a nominee for 3rd Air Force Airman of the Year in 1975. Jeff was promoted to a supervisory position, and supervised as many as forty fixed and mobile police patrols. Jeff was Awarded the Air Force Commendation Medal, the Air Force Good Conduct Medal with Oak Leaf Cluster and the National Defense Medal.
